MoarWaifus is intended for users in the United States and other jurisdictions where access to adult AI-generated content is legally permitted. This Service is not directed at residents of the European Union, the United Kingdom, or the European Economic Area. Users in those jurisdictions access the Service at their own initiative and bear responsibility for compliance with their local laws.

If you are an EU, UK, or EEA resident and you continue to use the Service, you acknowledge that your data will be processed in the United States under US law. You may exercise the rights described in Section 9 by contacting us at privacy@moarwaifus.com.

We collect the following categories of information:

• Account information — email address and username, collected and managed by our authentication provider, Clerk (clerk.com). We receive a user identifier and email address from Clerk upon registration.
• Content you create — prompts you submit, images you generate, AI companion conversation history, likes, comments, and any other content you create on the platform.
• Payment information — payment processing is handled entirely by CCBill, LLC. We receive transaction confirmation and your internal user ID; we do not store card numbers, bank details, or full payment credentials.
• Technical data — IP address, browser type, device type, operating system, referring URLs, and session information collected automatically when you use the Service.
• Usage data — which pages you visit, images you view, features you use, and interactions within the platform.
• Communications — if you contact us directly, we retain those communications.

AI companion conversations: Messages you send to and receive from AI characters are stored in our database and may be reviewed for moderation, safety, and service improvement purposes. Do not share sensitive personal information (financial details, government ID numbers, passwords) in AI companion conversations.

We use the information we collect for the following purposes:

• Service delivery — to provide, operate, and maintain the platform, process your generations, and manage your account and credit balance
• Safety and moderation — to detect, prevent, and respond to prohibited content, fraud, abuse, and violations of our Terms of Service
• Legal compliance — to comply with applicable laws and regulations, including mandatory reporting of child sexual abuse material (CSAM) to the National Center for Missing and Exploited Children (NCMEC) and relevant authorities
• Service communications — to send you transactional and account-related communications; we do not send marketing emails without your opt-in
• Security — to protect the integrity of our systems and users
• Service improvement — to understand how the platform is used and to improve it

We do not sell your personal data to third parties. We do not use your data for targeted advertising.

• Contract performance — processing your account data, managing credits, and delivering generated content is necessary to perform the contract with you
• Legitimate interests — detecting abuse, preventing fraud, maintaining security, and improving the Service, where these interests are not overridden by your rights
• Legal obligation — reporting CSAM and complying with lawful law enforcement requests
• Consent — where we ask for your consent for specific processing activities not covered above; you may withdraw consent at any time by contacting us, though this will not affect processing already carried out

We share data with the following categories of service providers who process data on our behalf:

• Clerk (clerk.com) — authentication and user account management; United States
• Supabase (supabase.com) — database and file storage; United States
• Vercel (vercel.com) — application hosting and serverless infrastructure; United States / global CDN
• Bunny CDN (bunny.net) — content delivery network for serving generated images and video; global
• CCBill, LLC (ccbill.com) — payment processing; United States
• Vast.ai (vast.ai) — GPU compute for AI generation; United States
• AI model providers — the language models and image generation models used to power our features process prompts and conversation content to generate responses
• Hive Moderation (thehive.ai) — automated content moderation scanning; United States

We do not authorize these providers to use your data for their own purposes beyond providing services to us. All data transfers to these providers are covered by appropriate agreements.

MoarWaifus operates in the United States. If you access the Service from outside the United States, your data will be transferred to and processed in the United States, which may not provide the same level of data protection as your home jurisdiction. By using the Service, you acknowledge and consent to this transfer. Where legally required, we rely on appropriate transfer mechanisms including standard contractual clauses.

We retain your data for as long as necessary to fulfill the purposes described in this Policy:

• Account data — retained while your account is active and for up to 90 days after deletion to allow for fraud investigation
• Generated images and prompts — retained while your account is active; public images may be retained for platform integrity purposes after account deletion
• AI companion conversation history — retained while your account is active and deleted with your account
• Payment records — retained for 7 years as required for financial and tax compliance
• Moderation logs — retained for up to 5 years for legal compliance and safety purposes
• Technical/server logs — retained for up to 90 days

Some data may be retained longer where required by law, to resolve disputes, or to enforce our agreements.

Depending on your jurisdiction, you may have the following rights regarding your personal data:

• Access — request a copy of the personal data we hold about you
• Correction — request correction of inaccurate or incomplete data
• Deletion — request deletion of your personal data, subject to legal retention obligations
• Restriction — request that we restrict processing of your data in certain circumstances
• Portability — receive your data in a structured, machine-readable format
• Objection — object to processing based on legitimate interests
• Withdraw consent — where processing is based on consent, withdraw it at any time

To exercise any of these rights, contact us at privacy@moarwaifus.com. We will respond within 30 days. We may need to verify your identity before processing a request. Some requests may be limited where we have legal obligations to retain data or where your request would affect the rights of others.

EU/UK residents: You have the right to lodge a complaint with your local data protection supervisory authority if you believe we have handled your data unlawfully.

We use automated systems for content moderation — specifically, automated scanning of generated images for prohibited content. This may result in your content being removed or your account being flagged for review. You may request human review of any automated decision by contacting us at privacy@moarwaifus.com.

We implement industry-standard technical and organizational security measures including HTTPS encryption in transit and encryption at rest. Access to personal data is restricted to personnel who need it to perform their duties. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials and should notify us immediately at privacy@moarwaifus.com if you suspect unauthorized access.

In the event of a data breach that poses a risk to your rights and freedoms, we will notify affected users and, where required by law, relevant supervisory authorities, within the timeframes required by applicable law.

MoarWaifus is strictly for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we discover that a minor has created an account, we will immediately terminate the account and delete all associated personal data. If you believe a minor is using the Service, please notify us at privacy@moarwaifus.com.

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):

• The right to know what personal information we collect, use, disclose, and sell
• The right to delete personal information we have collected from you
• The right to opt out of the sale of personal information — we do not sell personal information
• The right to non-discrimination for exercising your CCPA rights

We may update this Privacy Policy from time to time. We will notify users of material changes by updating the date at the top of this page and, where appropriate, by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Policy. If you do not accept the revised Policy, you must stop using the Service and may request deletion of your account.
