Terms of Service

By accessing or using MoarWaifus ("the Service," "we," "us," or "our"), you confirm that you are at least 18 years of age, have read and understood these Terms of Service ("Terms"), and agree to be legally bound by them. If you do not agree to these Terms in their entirety, you must immediately cease use of the Service. These Terms constitute a binding legal agreement between you and MoarWaifus.

• You are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
• You are legally permitted to access adult content under the laws of your jurisdiction
• You are accessing this Service voluntarily for your own personal use
• You will not permit minors to access the Service through your account

• Depicts, suggests, or implies minors (anyone under 18) in any sexual or romantic context whatsoever — this includes fictional, animated, or AI-generated depictions
• Depicts real, identifiable individuals without their explicit, documented consent
• Constitutes or could constitute child sexual abuse material (CSAM) in any form
• Promotes, glorifies, or facilitates violence, harassment, abuse, or harm toward any person or group
• Violates any applicable local, national, or international law or regulation
• Infringes upon any third-party intellectual property, privacy, or publicity rights
• Is intended to defame, impersonate, or harass any individual
• Attempts to circumvent our content moderation systems

You are solely responsible for all content you generate, create, or cause to be created using the Service. MoarWaifus provides generation tools; you determine what is generated and bear full responsibility for the outputs.

Specifically, you acknowledge and agree that:

• You will not use generated content in ways that violate these Terms or any applicable law
• You will not use generated content to harass, defame, defraud, or harm any person
• You are responsible for ensuring your use of generated content complies with the laws of your jurisdiction
• MoarWaifus bears no responsibility for how you use, share, or distribute content you generate
• Any legal liability arising from your generated content rests entirely with you

The Service is licensed to you for personal, private, non-commercial use only. You expressly agree that you will not:

• Use any content generated through the Service for commercial purposes, including but not limited to selling, licensing, or monetizing outputs
• Use generated content in advertising, marketing materials, or promotional campaigns
• Publish or publicly distribute generated content in ways that could create legal exposure for MoarWaifus
• Use the Service to generate content on behalf of third parties or as a commercial service
• Incorporate generated content into products, services, or applications for sale or distribution

Violation of this section constitutes grounds for immediate account termination and may expose you to claims for damages.

All images, text, and other outputs on this platform are generated by artificial intelligence models. You acknowledge and agree that:

• AI-generated outputs may not be protected by copyright under applicable law, and you may not claim copyright ownership over them
• Any resemblance of generated content to real persons, living or dead, is coincidental; if you intentionally generate content depicting a real person, you assume all legal risk associated with that choice
• We make no representations about the accuracy, quality, originality, or fitness for any purpose of AI-generated content
• AI models may produce unexpected, inconsistent, or unintended outputs and we are not liable for such outputs
• We grant you a limited, personal, non-exclusive, non-transferable license to use outputs you generate solely for the personal, non-commercial purposes described in Section 5

All visual content available on MoarWaifus is entirely artificial and synthetic — generated by AI image models. No actual human beings, performers, or real persons of any kind are depicted. All characters are entirely fictional. All depicted characters are adults aged 18 or older.

Because no actual sexually explicit conduct was filmed, photographed, or otherwise produced by real persons in connection with any content on this Service, the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 do not apply to the AI-generated synthetic content hosted here.

The Service includes an AI companion ("girlfriend") feature that allows you to interact with AI-powered characters. You acknowledge and agree that:

• AI companions are entirely fictional — they are not real people, do not have feelings, consciousness, or genuine relationships
• Any emotional connection you feel toward an AI companion is one-directional; the AI has no reciprocal experience
• AI companions are not a substitute for real human relationships, mental health support, or professional advice of any kind
• Conversations with AI companions are processed by third-party language model providers and are subject to their respective terms and policies
• We are not responsible for the content of AI-generated responses, which may be inaccurate, inappropriate, or inconsistent
• You will not use the AI companion feature to attempt to generate illegal content or to circumvent the content restrictions in Section 3

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms, pose a security risk, or are associated with fraudulent activity. Account terminations for Terms violations are not eligible for refunds.

Payment processing is provided by CCBill, LLC. By completing a purchase you also agree to CCBill's terms and conditions. Credits and subscription fees are non-refundable except where required by applicable law. Credits have no cash value, never expire, and cannot be transferred between accounts or redeemed for currency. We reserve the right to modify credit pricing and subscription fees with reasonable advance notice.

Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current paid period and no partial refunds are issued for unused time. Credits awarded with a subscription period are non-refundable once the period begins.

Refund requests for billing errors or unauthorized charges must be submitted to support@moarwaifus.com within 30 days of the charge. We will investigate and, where the charge was in error, issue a correction. We do not issue refunds for voluntary purchases of credits or subscriptions, for dissatisfaction with AI-generated outputs, or for accounts terminated due to Terms violations.

Chargebacks and payment disputes filed without first contacting us to resolve the issue constitute a material breach of these Terms and will result in immediate permanent account termination. We reserve the right to pursue recovery of disputed amounts through lawful means.

We employ automated and manual content moderation. We reserve the right to remove any content that violates these Terms or that we determine, in our sole and absolute discretion, to be harmful, offensive, or otherwise inappropriate — with or without notice. We are under no obligation to review all content and are not liable for any content generated by users that we fail to detect or remove.

The MoarWaifus name, logo, platform design, and all underlying software are the exclusive intellectual property of MoarWaifus and may not be copied, reproduced, or used without our express written permission. User-generated outputs are addressed in Section 6. If you believe content on the Service infringes your intellectual property rights, please contact us at legal@moarwaifus.com with sufficient detail for us to investigate.

You agree to indemnify, defend, and hold harmless MoarWaifus, its owners, employees, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) content you generate, submit, or share; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any misrepresentation you make in connection with the Service. We reserve the right to assume exclusive control of any matter subject to indemnification, in which case you agree to cooperate with our defense.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. Your use of the Service is entirely at your own risk.

To the maximum extent permitted by applicable law, MoarWaifus and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. In no event shall our total aggregate liability to you for all claims exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars ($100). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such jurisdictions our liability is limited to the fullest extent permitted by law.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved through binding individual arbitration rather than in court, except that either party may seek injunctive relief in court for intellectual property violations. You waive any right to participate in a class action lawsuit or class-wide arbitration. If arbitration is found unenforceable, disputes shall be resolved exclusively in the competent courts of the United States, and you consent to personal jurisdiction therein.

We reserve the right to modify these Terms at any time at our sole discretion. We will make reasonable efforts to notify users of material changes, including by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 4, 5, 6, 12, 13, 14, and 15 — shall survive.
